Will the stain come back through the new paint?

Only if the ceiling was not properly dry or not sealed. Water stains carry tannins that bleed through emulsion indefinitely - we seal with a stain block before skimming or painting, which is the step most often skipped.

Can you patch it or does the whole ceiling need doing?

A patch is fine on a plasterboard ceiling and usually invisible once painted across. On a small room, or where the damage is in the middle of a plain ceiling, skimming the whole thing is sometimes only a little more and removes any risk of a shadow.

The leak came from the flat above - who pays?

How soon after a leak can the ceiling be repaired?
